All services are rendered with the utmost care and consideration for you and your brand, your clients and each final product.
However we ask that you please read these Terms and Conditions carefully before booking any of our services.
Please note ‘we’ and ‘our’ are used interchangeably with ‘RARE Creative’. Use of any of our services including but not limited to photography, videography, floor + site planning, is conditioned on your acceptance of and compliance with these terms and conditions.
By booking or using any of our services you agree to be bound by these terms and conditions.
1. LISTINGS MUST BE SHOOT READY.
All properties must be ‘ready to shoot’ before our creative team arrive.
1.1 Our job is to make you (and your listing!) look it’s very best. Our team assess and make minor adjustments as needed (both on-site and in post production) to ensure the highest quality images. However, we assume that the property has been prepared and presented as the agent and homeowner would like it to be captured. Please ensure that all cleaning, styling, major decluttering and furniture rearrangement is completed prior to our creative team arriving. Under some circumstances a ‘repeat visit’ fee will be automatically incurred for excessive time spent waiting for property preparation to be finalised.
1.2 If the agent / owner is not attending shoot, the property will be shot ‘as is’. If you are not attending the property we will consider you to have deemed the property ‘shoot ready’ and assume that you will have advised us of any preferred angles / shots. The photographer / videographer will choose the best shots that the package allows for. We have high quality standards and well-honed creative instincts, but if additional direction was not specified and a re-visit request is made – a ‘repeat visit’ fee will apply.
1.3 If our creative team is asked to return to a property to capture additional content – there will be a minimum repeat visit fee of $150 + potentially other charges for extra work completed / requested, to be discussed at the time of booking.
1.4 The photographer / videographer may take extra angles outside of the package inclusions at the property, which may or may not be included in delivered images at our professional discretion. Upon enquiry, additional shots may be added to the package for an extra fee as per our price guide.
2. RESCHEDULES & CANCELLATIONS
2.1 As a professional courtesy we greatly appreciate a minimum of 24 hours notice to re-schedule any bookings. We do understand that in this industry, circumstances can change fast, so we aim to be as flexible as possible. Taking that into account, should a booking be cancelled (without rescheduling) less than 2 hours before it’s scheduled commencement time, a fee equating to 50% of the booked package price will apply.
2.2 In the event of rain, we will give you the option to reschedule at our next possible availability. In the event that the shoot continues as planned and is then called off once our creative team is already on-site a repeat visit fee will apply for the returning visit.
3. PRODUCT TIMELINES
3.1 We aim to meet the below service timelines at every opportunity – however from time to time due to the nature of creative work and our commitment to excellence, this timeframe may vary slightly. If there is an extra level of urgency at play please advise us at the time of your shoot and we will do our best to cater to this.
Photos; generally available within 24 hours of the photo shoot taking place and are supplied the next business day.
Floor Plans; generally available within 24 hours of the booking taking place and are supplied the next business day.
Videos; generally available within 48 hours of the booking taking place (excludes weekends).
Photoshop; – we include minor editing as standard, however advanced photoshop / decluttering or change requests will incur a surcharge and may extend the delivery schedule.
4. PROMOTIONAL VIDEOS
4.1 We use our own creative license and experience in making promotional videos. We encourage you to share your inspiration and vision in advance of the shoot and will take this into account wherever possible and feasible. Please note that excess charges may apply for custom videos, re-edits and re-shoots that are requested.
4.2 Please refer to our ‘picture perfect’ property prep guide to ensure that your listing is video ready.
4.3 Promotional videos include 1 round of revision. Please note that excessive changes may lead to delays in delivery of video and additional editing charges of $110 per hour + any other fees incurred for additional work completed.
4.4 We may refuse to use any drone / UAV footage provided by agent / owner unless they can supply evidence that a CASA qualified pilot has taken the footage.
4.5. Promotional videos are supplied as either horizontal / cinematic (landscape – .mp4 file) or social / vertical (portrait – mp4 file) as per your booking request. If any other format is required please let us know at the time of booking. A surcharge will apply if a different format is requested after the shoot has occurred.
5. FLOOR PLANS & SITE PLANS
5.1 The floor plans and site plans we provide are for marketing purposes only. While all care is taken no guarantee can be given in respect of accuracy; sizes and dimensions are approximate, actual may vary. Our plans are supplied with this disclaimer in place for your peace of mind.
6. DRONE / UAV FOOTAGE
5.1 Safety First! The pilot may cancel / reschedule booking if they feel the conditions unsafe.
5.2 The pilot may overrule vendor/agent requests if they exceed the guidelines defined by CASA.
5.3 It is the responsibility of the agent to notify other residents / neighbours that a drone shoot will be occurring. If this hasn’t been done, the pilot may cancel / reschedule booking should a conflict arise.
7. CONTENT COPYRIGHT & APPROPRIATE USEAGE
7.1 Please note that under Australian law the photographer retains all ownership/copyright of images taken. RARE Creative retains all ownership / copyright of all intellectual property produced by our services including but not limited to images, videos, floorplans, site plans and any raw materials or project files. Use of the any intellectual property without express permission is prohibited.
7.2 RARE Creative gives limited license to our clients / agents to use our images for the advertising and promotion of their client’s property – for a limited time only (i.e. the duration of their initial listing / sales cycle). In the event that our client sells / loses the listing, our images or intellectual property cannot be passed onto another agent without express permission from RARE Creative.
7.3 The on-selling of RARE Creative’s media after the sale of a property is strictly prohibited.
7.4 RARE Creative in no way accepts liability for any loss or damage caused by taking action as a result of material viewed on or sourced from our services. RARE Creative in no way accepts liability for modifications to photos after delivery of photos.
7.5 RARE Creative reserves the rights to use any photos, videos and / or floorplans taken for advertising and promotion.
7.6 Any unauthorized use of RARE Creative’s products without written permission may result in higher levels of action taken.
7.7. RARE Creative’s images and videos may be re-licensed for a charge per photo for use outside of the sales license. Please contact us if you wish to do this.
7.8 RARE Creative reserves the right to hold photos until full payment is made.
7.9 It is the responsibility of the real estate agent / agency to notify the customer of these terms and conditions.
8. PAYMENT
8.1 You (the buyer) shall make payment of all monies outstanding to RARE Creative (the Seller), such that payment is received by the seller within fourteen (14) days of the Seller’s tax invoice.
8.2 If payment is not made in accordance with the above terms the Seller shall be entitled to recover from the Buyer and the Buyer will be liable for payment to the Seller of:
Default interest at the rate of 2.0% per month calculated on a daily basis on all monies due but unpaid. Such interest will be computed from the due date of payment.
An account keeping fee of 5% per month (or on any part of a month) on all monies remaining overdue for payment on the first day of any month.
All damages, expenses and costs of collection (including but not limited to all charges and commission actually paid and/or contingently payable to a mercantile agent and/or fees payable to a solicitor) relating in any way whatsoever to recovery of overdue monies, in addition to all other remedies the Seller shall have at Law.
8.3 Supply of further services may be ceased if payment has not been made within 15 days of the due date.
